Terms of Use.
The terms that apply when you use the National IT website.
About these terms
This website is operated by National IT Solutions Pty Ltd (ABN 53 102 903 122) (“National IT”, “we”, “us”). These terms govern your use of this website. By using the website you agree to them.
Services we provide to clients are governed by a signed Managed IT Services Agreement and its Order, not by this page. If there is any inconsistency between these terms and a signed agreement, the signed agreement prevails.
Use of this website
You may browse this website and use its content to learn about our services. You must not misuse the website. That includes attempting unauthorised access to it or its hosting environment, probing or scanning it for vulnerabilities without our written consent, introducing malicious code, scraping content at scale, or using it in any way that breaches applicable law.
Content and intellectual property
All content on this website, including text, graphics, logos, case studies and page design, is owned by or licensed to National IT and protected by copyright and trade mark law. You may not reproduce, distribute or create derivative works from it without our written permission, other than as permitted by law.
Information only, not advice
The material on this website is general information about our services. It is not advice for your specific circumstances, and it does not form part of any contract. While we take care to keep content accurate and current, we make no warranty that it is complete or error-free. Seek specific advice before acting on anything you read here.
Case studies and testimonials
Case studies and client quotes on this website describe real engagements and are published with the client's permission. They reflect the outcomes achieved for those clients in their circumstances; results vary, and past outcomes are not a promise of future results.
How our engagements work
If you become a client, our standard engagement is set out in a Managed IT Services Agreement and an Order that together cover, among other things:
- the services being provided and the supported environment, including any inclusions, exclusions and assumptions;
- response targets under a Service Level Agreement;
- fees, invoicing and payment terms, including annual adjustment;
- use of third-party software, services and security products, which remain subject to the relevant vendors' licence terms;
- each party's responsibilities for security, access and the customer environment; and
- term, termination and dispute-resolution processes.
A copy of the current agreement is provided before any engagement is signed, and a full copy of the User Guide and Service Level Agreement is provided at onboarding.
Consumer guarantees
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing on this website or in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under law that cannot lawfully be excluded.
Third-party links and the client portal
This website links to third-party sites, including vendor resources and our client portal. Those sites have their own terms and privacy practices, which we do not control, and linking to them is not an endorsement. Use of the client portal is subject to your service agreement with us.
Liability
To the maximum extent permitted by law, and subject always to the Australian Consumer Law, we exclude liability for loss or damage arising from your use of, or reliance on, this website or its content.
Changes
We may update this website and these terms at any time. Changes take effect when published on this page.
Governing law
These terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria.
